Permission to mine in Spain does not come from a single authority. Mining law is national, while the granting and supervision of permits sits largely with the autonomous communities, and environmental assessment brings in a separate process with its own thresholds, consultation requirements and appeal routes — over which sits European law that member states implement in their own instruments. An operator therefore navigates several regimes at once, and this section describes them as machinery rather than as obstacle or protection.

The sequence matters more than any single rule. Exploration permits and mining concessions confer different rights and carry different obligations, and they are granted for defined areas and terms with work commitments attached. Environmental assessment determines whether a project may proceed and on what conditions, drawing in water authorities, heritage bodies and municipalities. Materials containing naturally occurring radioactivity, as monazite-bearing streams do, engage radiological rules that sit outside mining law entirely. Closure and financial assurance obligations are set at approval and endure past production. Each of these can be challenged, and judicial review is a routine feature of the landscape rather than an aberration.

The architecture has a definite shape: decisions are taken at particular levels of government, a full assessment is triggered by thresholds that a screening is not, public participation is structured and occurs at defined points, an appeal can achieve some things and not others, and European instruments reach domestic permitting through national implementation.
